New York Landlord-Tenant Law at a Glance
Since the Housing Stability and Tenant Protection Act (HSTPA, 2019), maximum is 1 month's rent statewide. Must be returned within 14 days of move-out with itemized deductions.
14-day rent demand required for nonpayment before filing. No-fault terminations require 30 days (< 1 year), 60 days (1–2 years), or 90 days (2+ years) notice. HSTPA significantly strengthened tenant protections.
New York City has extensive rent regulation: Rent Control (older units) and Rent Stabilization (buildings with 6+ units built before 1974, or buildings receiving tax incentives). NYC is subject to the most comprehensive rent regulation in the US.

NYC Housing Court is heavily backlogged — uncontested cases take months. Upstate courts are significantly faster. HSTPA added new procedural requirements that slow the process.
