New Jersey Landlord-Tenant Law at a Glance

Security Deposit Limit
1.5 months

Maximum is 1.5 months' rent (NJ Stat. § 46:8-21.2). Annual increases limited to 10% of current deposit. Must be returned within 30 days (5 days after fire/flood). Deposit must be held in a separate account.

Notice Requirements
30 days (for most violations) / no notice required (nonpayment after default judgment)

New Jersey requires a 30-day notice for most lease violations. Landlords must first obtain a court judgment for nonpayment before physical removal. Just cause required for eviction in most cases.

Rent Control
City-level only

New Jersey has no statewide rent control, but many municipalities — including Newark, Hoboken, Jersey City, Trenton, and others — have rent control or stabilization ordinances.

Eviction Timeline
6–12 weeks

New Jersey's eviction (Summary Dispossession) process is tenant-protective and often takes 6–12 weeks. Landlord-tenant courts are heavily backlogged in some counties.
