New Jersey Landlord-Tenant Law at a Glance
Maximum is 1.5 months' rent (NJ Stat. § 46:8-21.2). Annual increases limited to 10% of current deposit. Must be returned within 30 days (5 days after fire/flood). Deposit must be held in a separate account.
New Jersey requires a 30-day notice for most lease violations. Landlords must first obtain a court judgment for nonpayment before physical removal. Just cause required for eviction in most cases.
New Jersey has no statewide rent control, but many municipalities — including Newark, Hoboken, Jersey City, Trenton, and others — have rent control or stabilization ordinances.
